FAQ

What is a bail bond?

A bail bond is a financial guarantee that once a person is released from jail, they will follow through on their obligation to appear in court. The bail bondsman puts up the money and serves as the party making the guarantee that the defendant will appear in court. Failure to appear in court results in the bail bond being forfeited and a warrant issued for the arrest of the defendant.

What is an indemnitor and do I have to have one?

An indemnitor is the person who co-signs for your bond. An indemnitor is required for the bond process. If you are an inmate and cannot obtain an indemnitor, we are unable to help you.

How soon can I (or my loved one) get out of jail?

New Braunfels Bails Bonds works as quickly as possible to secure your release, but we cannot move faster than the courts. We cannot secure your release until after the bail amount has been set by the Comal County magistrate (judge), which typically occurs each morning. Anyone arrested in the evening or at night will have to spend the night in jail.

We’re available 24 hours a day, so you can have us begin the process and be ready to secure your release as soon as the judge sets your bail.

What are the steps in the bail bond process?

For a complete explanation of the bail bonds process, please see our Bail Bonds Process page.

How is bail determined?

Your bail will be determined solely by the Comal County magistrate (judge). Bail depends on the severity of the crime and any criminal background that appears in your record.

What do your services cost?

Our costs are based on a percentage of the bail set by the Comal County magistrate. We are an approved bail bondsman for Comal County.

Will I get my money back?

No. The fee paid to a bail bondsman to secure the bond is nonrefundable.

Will I owe any more money?

In most cases, no. The money paid to secure a bail bond is paid up front. Additional costs can and will be incurred if you (the defendant) fail to appear in court. In that case, you and the co-signer on the bond will become liable for a variety of costs:

  • Court costs
  • Fees from the bond forfeiture
  • Collection fees
  • Any fees incurred to locate you (the defendant)

What obligation do I have to you when you arrange my bail?

You are required to appear in court on your appointed court date(s). If you hire an attorney, you are still obligated to appear in court on your assigned court date(s). If you (or your attorney on your behalf) fails to appear, a warrant for your arrest will be issued. A no-show of your attorney does not relieve you of your obligation to appear.

We require you to call in weekly. You are also required to notify us if your whereabouts, employment, and / or court date(s) have changed.

I’m angry that my relative got arrested for a DWI and I want to teach him/her a lesson. Can I leave him/her in jail and not arrange bail?

You certainly can, although it means your relative will remain in jail until the case comes up for trial. That can take months.

I’m not guilty — can you help me?

We are able to help anyone who has been arrested in Comal County, TX, obtain bail regardless of guilt or innocence. Guilt or innocence is determined by a court of law, not by us. We can only help you get out of jail.

If I call you and I have money for your fee, are you required to bail out my friend?

No. As an independently owned and operated bail bonds company, we can decline to post bail if we feel that it is too much of a risk.

How long have you been in business?

Our company was founded in 2008. Our company is locally and family owned and operated, and we have affiliated locations in Gonzales, Caldwell, Guadalupe, and Hays Counties.
